Terms and Conditions
Welcome to Signal Auto Logistics LLC (“Signal Auto Movers”). By using our services, you agree to be bound by the following Terms and Conditions (“TERMS”). These TERMS apply to all transactions and supersede any other agreements or documents. Any modifications to these TERMS must be made in writing by Signal Auto Movers.
1. Acceptance of Terms
By using Signal Auto Movers’ services, you (“Customer”) and any entity you represent agree to these TERMS. These TERMS override any conflicting documents and can only be modified by Signal Auto Movers. Your continued use of our services constitutes acceptance of these TERMS.
2. Services
Signal Auto Movers is a licensed auto transportation brokerage acting as an agent between Customers and carriers. Signal Auto Movers arranges the transportation of vehicles but does not transport or take possession of vehicles. Pickup and delivery dates provided by Signal Auto Movers are estimates and are not guaranteed. Signal Auto Movers is not liable for delays due to weather, carrier operations, or other uncontrollable factors.
3. Shipment Categories
- Gold Standard (GS): Estimated premium market rate with a pickup window of 1-3 business days. 95% of orders ship at this rate without a price increase. There is a 5% chance of a carrier rate increase.
- Gold Rush (GR): Priority rate with a set or next-day pickup window. Signal Auto Movers compensates carriers for any price increases. If the vehicle is not picked up within the specified timeframe, Signal Auto Movers will incrementally increase the carrier payment, but this will not affect the Customer’s price.
4. Delivery Dates
Delivery dates are estimated and not guaranteed. Timelines may vary due to weather conditions, carrier operations, or other unforeseen incidents. Signal Auto Movers are not responsible for any transit delays as a brokerage, as carriers navigate the shipment of the actual cargo. However, Signal Auto Movers will certainly apply effort to expedite and help coordinate delays between customers and carriers when needed. If a delay exceeds 5 business days, Signal Auto Movers may graciously supplement the customer for up to 5 days of car rental fees at $30 per day, with exceptions for unforeseen incidents such as acts of nature, war, or illegal acts.
5. Customer Responsibilities
- Accurate Information: Ensure all shipment details are accurate and notify Signal Auto Movers of any changes, which may incur additional fees or prohibit the transport.
- Vehicle Condition: Inform Signal Auto Movers about the vehicle’s size and condition to assign the proper equipment. Additional fees may apply for inaccurate information.
- Vehicle Preparation: Prepare the vehicle for transport by securing or removing loose parts and with sufficient fuel for loading and unloading.
- Alarm Systems: Disarm any alarm systems in the vehicle.
- Personal Property: Signal Auto Movers isn’t allowed to advice customers to leave any personal items in the vehicle. Prohibited items include explosives, firearms, flammable products, live pets, plants, contraband, drugs, alcohol, and illegal goods.
- Double Book: When customer engages in multiple booking, placing order for the shipment of the same vehicle with one or more brokers, Signal Auto Movers shall not be held responsible for any discrepancies, issues, or conflicts arising from rates, carrier selection, or service quality. Customer acknowledges that double booking may lead to confusion, delays, and potential additional costs, for which Signal Auto Movers will not be liable. It is the sole responsibility of the Customer to ensure clear communication and coordination with all involved parties to avoid such complications.
6. Pickup and Delivery
- Location Changes: Points of origin and destination may change due to accessibility issues.
- Inspection: Customers or their agents must be present for vehicle inspection at pickup and delivery. Any pre-existing and new damages must be noted on the Bill of Lading. FAILURE TO NOTE DAMAGES AT DELIVERY on the Bill of Lading confirms receipt in satisfactory condition, absolving Signal Auto Movers and the carrier of further responsibility.
7. Carrier Responsibilities
Carriers must transport the vehicle as close to the designated points as possible and in a commercially reasonable manner. Carriers are responsible for the care and physical transport of the vehicles. Carriers are contractually liable for any damages to the vehicles, delays, and inconveniences due to negligence, equipment failure, accidents and miscommunication to customers. Customers may also be subject to the carrier’s terms and should contact the carrier for any disputes regarding their documents.
8. Fees and Payment
- Partial/Deposit Payment: Deposit is due when a carrier is ready to be assigned (just before a carrier accepts the order). Balance payments to the carrier must be made at delivery(typically Cash or Electronic transfer), or unless other terms agreed prior upon dispatch. Unpaid invoices may accrue interest, and non-payment can result in storage charges.
- Full Payment: If Signal Auto Movers is designated/contracted to collect full payment for the entire transport service, for many practical reasons, the full payment is due when a carrier picks up the order/vehicle and must clear 4 hour before delivery of the units.
- Non Payment: Unpaid invoices may accrue interest, and non-payment can result in collections, storage charges, and potentially a lien on and ownership of the vehicle by the carrier.
9. Cancellation and Refund Policy
- Before Vehicle Dispatch: Orders can be cancelled at no cost before carrier acceptance. After acceptance, a $358 cancellation fee applies. Refunds are only for unfulfilled services. Cancellation requests must be submitted via email dispacth@signalmovers.com
- After Vehicle Dispatch: Customers can cancel orders but forfeit the full deposit amount, if cancelling after accepting a carrier offer or after the carrier has been dispatched. If the carrier initiates loading and the Customer cancels, they also forfeit the full deposit amount. If Customer is unpleased with the carrier at loading time for reasonable concerns and reasons, Signal Auto Movers will attempt up to three times to find a substitute carrier; if unsuccessful, only then Customer can cancel and receive a refund. Additional charges apply if the Customer fails to show up for scheduled pickup or delivery. Please be respectful, reasonable, gracious to our carriers and network.
10. Loss, Damage, or Delay Claims
Signal Auto Movers is not liable for cargo loss or damage; claims must be filed directly with the carrier. Customers must notify Signal Auto Movers of any claims within 48 hours of delivery to receive assistance with relevant documents.
11. Indemnification
Customers agree to indemnify Signal Auto Movers against any claims arising from their acts or omissions.
12. Disclaimer and Limitation of Liability
Signal Auto Movers’ liability is limited to the total fees paid by the Customer. Signal Auto Movers disclaims all warranties and is not liable for indirect, incidental, or consequential damages.
13. Dispute Resolution and Arbitration
- Binding Arbitration: Any disputes must be resolved through binding arbitration on an individual basis, not as part of any class or representative action. This includes all claims related to these TERMS and services provided by Signal Auto Movers.
- Arbitration Procedures: Arbitration will be conducted by the National Arbitration and Mediation (NAM) under its rules, with fees paid by the filing party. Claims must be filed within three years.
14. Miscellaneous
- No Partnership: This agreement does not create a partnership, joint venture, or employment relationship between the parties.
- Assignment: Customers cannot assign rights without Signal Auto Movers’ consent.
- Entire Agreement: These TERMS are the entire agreement between the parties and supersede all prior communications.
- Marketing: Signal Auto Movers reserves the right to use the Customer’s name and logo for marketing purposes unless declined by the Customer via email.
By using Signal Auto Movers’ services, you agree to these TERMS and waive any claims based on not having read or understood them.
